The policy is part of an interim final rule implementing immigration fees and requirements under the H.R. 1 Reconciliation Act of 2025, also known as the One Big Beautiful Bill Act. DHS said the law created new fees to help fund immigration enforcement operations and ensure that noncitizens pay for immigration services. U.S. Citizenship and Immigration Services previously published a Federal Register notice on July 22, 2025, establishing a filing fee for Form I-589, Application for Asylum and for Withholding of Removal, as well as an annual asylum fee. The annual fee must be paid for each calendar year that an asylum application remains pending. Under the new rule, if an asylum applicant does not pay the annual fee within 30 days of receiving notice, USCIS will reject the pending asylum application. DHS said that if the applicant does not have legal status in the United States, USCIS also will initiate removal proceedings. The rejection of an asylum application would carry additional consequences. USCIS said it will deny any pending Form I-765, Application for Employment Authorization, if the work permit request is based on the asylum application. Applicants who had already received work authorization based on a pending asylum case would lose that authorization immediately. The interim rule also includes other immigration fee and employment authorization changes. USCIS will keep the filing fee for Form I-589 if the agency rejects the form because it was improperly filed. The rule also updates regulations for Temporary Protected Status, limiting employment authorization for TPS holders to one year or the remaining period of the TPS designation, whichever is shorter. The rule also establishes a minimum $24 filing fee for Form I-102, Application for Replacement\/Initial Nonimmigrant Arrival-Departure Document, in addition to other required fees. The interim final rule takes effect May 29, 2026. USCIS said it will reject any Form I-102 postmarked on or after that date if it is submitted without the proper filing fee. The agency also will begin rejecting pending Form I-589 asylum applications for applicants who fail to pay the annual asylum fee starting May 29. DHS said it will accept public comments on the rule through June 29, 2026."}
